1. INTRODUCTION

1.1. The Terms & Conditions of sale detailed below only govern the contractual relationship between the User/Customer, hereafter referred to as «You» and COREcarbon hereafter referred to as «We» and as « COREcarbon». This Terms & Conditions of sale are applicable only to the COREcarbon Website www.corecarbon.co.za.

1.2. Both parties accept these conditions unreservedly. These general conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation. We maintain that, by confirming your order, you unreservedly accept our Terms & Conditions of sale, having read them. These Terms and Conditions of sale are important for you and COREcarbon as they have been designed to protect your rights as a valued customer and to protect our rights as a business and to create an understanding between both parties.

2. ORDERING A PRODUCT (ONLINE SHOPPING: WWW.VSIBIKES.COM)

2.1. You must be at least 18 years old to order.

2.2. You have to place the order on our retail Website: www.vsibikes.com (24 hours a day and 7 days a week).

2.3. The ordering process consists of easy steps:

• Login to your account

• Select product/s

• Go to shopping cart

• Confirm all details are correct

• Proceed to checkout

• Choose payment option

• Proceed with payment

Shipping and delivery details, including invoice will be sent to your registered email address.

3. PRODUCT SPECIFICATION

3.1. Published product details, specifications and suitability information is the best available at the time. COREcarbon shall not be held responsible for the accuracy of any advice given regarding the suitability (or otherwise) of any part/s required for the repair of an item. If you have ordered an item that has an unsuitable product description, we will remedy this by providing you a full refund upon the return of the item.

3.2. We encourage you to ensure all spare parts are fitted by a competent person in accordance with manufacturer specifications. COREcarbon cannot be held liable for any damage caused by the fitting of a spare part.

3.3. Please ensure that you have read your warranty conditions before attempting to install a part or otherwise repair item. COREcarbon cannot be held responsible if the item is damaged or your warranty is voided. Our manufacturer guarantees require you to use a qualified cycle technician at one of the preferred partners.

4. PRICING

4.1. The prices for the products are indicated as below:

5. AVAILABILITY / ESTIMATED DELIVERY TIMES

5.1. We do our best to ensure availability of all advertised products and endeavor to dispatch all parts within the quoted time. If there is a delay, we will inform you of this via email and the product will be dispatched as soon as it is available. If you have ordered multiple items they may arrive separately.

5.2. We have no liability to you for any delay in the delivery of products ordered. We will do our best to get all orders sent out as quickly as possible. You have the right to cancel delayed orders at any time, just contact us with your order number.

5.3. Occasionally we find ourselves having to withdraw an item because it has become obsolete or has been discontinued. If you have placed an order for an item that has been made obsolete, we will inform you as soon as possible and offer you an alternative if available.

6.1. You can make your payments in different ways:

You must have an account with Paypal to complete the purchase. If YOU do not have one of these, YOU will be asked to create one before YOU can complete payment.

6.2. VSIBIKES reserves the right to refuse an order placed which has not been totally paid.

6.3. VSIBIKES controls all the orders that have been validated on the website. These controls aim to protect VSIBIKES from abusive practices operated by a fraudster. Our services might ask you to provide additional information to unblock your order: proof of address or a utility bill in your name, or proof of address in the name of the person indicated for the delivery address, etc… These requests could be made by email for example, for orders with delivery address different to the billing address.

7. CREDIT CARD SECURITY

7.1. In order to ensure secure payments, we offer the use of secure servers where information is protected by Secure Sockets Layer (SSL), the industry standard encryption technology. SSL works with Netscape Navigator, Microsoft Internet Explorer, AOL and other browsers. This encryption makes it virtually impossible for unauthorized parties to read any information that you send us.

This means that there is no way that someone can obtain your credit card number from CRC so you can order with confidence! 8. SATISFIED OR YOUR MONEY BACK

8.1. COREcarbon allows you 7 days to return/exchange a product that you are not satisfied with. Your right of retraction starts from the moment your order is delivered; shipping cost will be for the customer’s account. You can return/exchange the product within this time frame, with your invoice and the completed Returns Form. In case you wish to exchange the product, we will send the parcel at standard shipping rates with the standard delivery service.

8.2. The present right of return/exchange only applies to products that are returned in their original and complete working condition (packaging, accessories, user guide etc.). Any product that has been damaged, is not in its original packaging, has packaging that has been worn beyond simply opening the product, will not be refunded.

9. PRODUCT GUARANTEES

9.1. If you find a defect, or are not satisfied with our product, you may return it for a full refund, exchange or request a replacement within the first 7 days or as per manufactures guarantee.

9.2. The legal guarantee concerning product conformity does not apply in some cases:

• When damage is caused by external factors such as shocks, lightning, power surges, rust and sand.

• When damage is caused by the customer’s non-respect of the manufacturer’s instructions regarding the use and installation of the product.

• When damage is caused by the customer’s misuse of the product.

• When the customer is aware of damage to the product at the time of placing his order.

10.1. For all stages, from access to the website, browsing, filling in forms, placing an order, delivering items or any other service, COREcarbon only has an obligation for due care. Therefore, COREcarbon cannot be held responsible for any inconvenience or damages arising from the use of the Internet and completely outside the diligence and precautions taken by COREcarbon.

10.2. In particular, COREcarbon cannot be held responsible for any disruption in provision of the service, or any external intrusion or presence of a computer virus. Customers benefit from guarantees offered by the brands listed on the website.

11.1. We encourage you to leave reviews, comments and product questions on our website. We regularly monitor this content and we reserve the right to remove, reject or edit it at any time. When submitting information to our website as a review, product question or customer comment you understand that what you have submitted is not copyright protected and you are permitting its appearance on the COREcarbon website.

13. Force Majeure

13.1 We shall be not liable to you or deemed to be in breach of this Contract by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the Contract, if the delay or failure was due to any cause beyond our reasonable control such as (but without limitation) any strike, lock-out or other form of industrial action, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of supplier or sub-contractors or inability to obtain materials required for performance of the Contract.

14. Third party rights

14.1 A person who is not a party to the Contract will not have any rights under or in connection with it by virtue of the Contracts.

15. Severance

15.1 If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions shall remain in full force and effect.

16. Waiver

16.1 If either you or us fail or delay or compromise in exercising a right or remedy under the Contract, the right or remedy is not to be treated as having been waived, restricted or varied and any agreement by either you or us to refrain from exercising a right in one particular instance will not prevent you or us from exercising it in full in the future.

17. Cumulative remedies

17.1 All rights and remedies available to either you or us under the terms of the Contract or under the general law are to be cumulative, and no exercise by either you or us of any such right or remedy is to restrict or prejudice the exercise of any other right or remedy granted by the Contract or otherwise available to you or us.

18. Governing law and jurisdiction

18.1 The Contract shall be governed by the laws of South Africa and any court proceedings in relation to the Contract are to be brought in the South African Courts.
